TERMS & CONDITIONS
REGISTRATION: All prospective buyers are required to register prior to the auction and/or prior to bidding. A valid driver’s license is required. A buyer number will be provided at registration. By signing the registration agreement, you are accepting all terms and conditions set forth below.
JUDGMENT OF ITEM OR PROPERTY SOLD: All property sells as is, where is without warranty of any kind, expressed or implied. There are not and will not be warranties on quality, character, or condition of any item sold in auction. Bidders shall inspect items prior to bidding and determine the condition for yourself. Red Bird Auction Company offers no warranty on any item or property sold.
BUYERS CATALOG: All descriptions and conditions of equipment in catalog (online or in print) are believed to be correct and have been provided by the Seller. However, neither the Seller nor Red Bird Auction Company are responsible for errors in descriptions or condition. Year, model, mileage, meter reading, and condition are not guaranteed. The buyer accepts responsibility to inspect and verify item status prior to bidding. Manufacturer warranties listed in the catalog are provided by the Seller to Red Bird Auction Company and are not verified. Buyers must verify such information for themselves. Red Bird Auction Company is in no way responsible for discrepancies. The catalog acts as a guide only.
ITEM INSPECTION: The buyer agrees to rely on personal inspection of any item in auction.
RISK OF LOSS: The buyer assumes full responsibility and risk of loss for all items purchased from the time auctioneer says sold to the buyer.
PAYMENT TERMS: Every item must be paid for on date of sale unless arranged prior to auction in writing. Cash, cashier’s checks, and certified checks are accepted. Business and personal checks are accepted only if accompanied by a current bank letter guaranteeing payment to Red Bird Auction Company. Wire transfers are accepted. Credit cards are accepted provided the buyer agrees to not stop payment from credit card company and pay the 3.5% transaction fee to Red Bird Auction Company. The buyer agrees to not remove the item from the auction yard until full payment is received and cleared.
TAXES & TITLES: All items are subject to state and local tax laws. If a buyer is exempt from sales tax, Red Bird Auction Company must have copy of Sales Tax Certificate prior to payment. Failure to do so will result in the buyer paying current sales tax rates. Titles will be mailed within ten (10) business days.
OFFICE & AUCTION SITE HOURS: The Red Bird Auction Company office is open Monday through Friday from 9:00 am to 5:00 pm. Auction site hours for inspection will be the same as office hours for two weeks prior to auction day.
ITEM REMOVAL/CHECK OUT: Items shall only be removed from the auction yard by the buyer once the buyer has paid in full for items bought and has received a check out ticket from the front office. Items must be picked up within one week of the auction date or the buyer/owner will be charged a twenty-five dollar ($25) fee per day per item storage fee. Items not picked up will be sold absolute in the next auction.
AUCTION SITE: Buyers acknowledge that the auction site and anywhere the property is being sold or displayed is a potentially dangerous place and at all times shall be at their own risk with no notice of the conditions of the premises.
BUYER’S FEES: A 10% buyer’s premium will be charged on all items selling from $501.00 to $25,000.00.
A 5% buyer’s premium will be charged on any amount of over $25,001.00 up to the total purchase price.
A 15% buyer’s premium will be charged on all items sold at $500.00 and less.
